Terms and Conditions

Terms governing website use and Quixprint projects.

Important: These terms govern use of Quixprint.com and printing projects ordered from Quixprint. Because these are legal terms, Quixprint should have them reviewed by a qualified attorney before launch.

Terms and Conditions

By accessing or using this website, requesting a quote, approving an estimate, or ordering products or services from Quixprint, LLC (“Quixprint”), you agree to these Terms and Conditions and applicable law.

1. Quotations and estimates

Unless stated otherwise in writing, quotations and estimates are valid for fifteen calendar days from issuance. Pricing may be revised if project specifications, quantities, materials, files, schedules, shipping requirements, or other information differs from what was originally provided.

2. Order approval and proofing

Customers are responsible for reviewing and approving all project specifications, artwork, copy, dimensions, bleeds, folds, quantities, materials, colors, shipping details, and proofs before production. Approval authorizes Quixprint to begin production. Quixprint is not responsible for errors contained in customer-approved artwork or proofs.

Proofs are provided when included in the quote or requested and available. Changes made after proofing or approval may result in additional charges and schedule changes.

3. Customer-supplied files and specifications

Customers are responsible for providing complete, accurate, production-ready files and maintaining backup copies. Additional work required to prepare, correct, convert, or otherwise use supplied files may be billed separately. Quixprint is not responsible for output problems caused by incomplete, damaged, low-resolution, incorrectly formatted, or otherwise unsuitable customer files.

4. Color and production tolerances

Colors displayed on screens and electronic proofs may differ from printed output. Variations may also occur between production methods, materials, coatings, inks, equipment, and separate print runs. Unless a specific written standard has been agreed upon, commercially reasonable color and production tolerances will apply.

Overruns or underruns of up to five percent may occur on custom production unless otherwise agreed in writing.

5. Customer content and intellectual property

The customer represents that it owns or has permission to use all artwork, trademarks, logos, photographs, text, and other content supplied to Quixprint. The customer is responsible for ensuring that submitted materials do not violate intellectual-property rights, privacy rights, publicity rights, or applicable law.

Quixprint may decline content or projects that it reasonably believes are unlawful, infringing, fraudulent, threatening, defamatory, obscene, or otherwise objectionable.

6. Production schedules

Production times begin after Quixprint has received all required materials, approvals, and payments, and the project is deemed production-ready. Turnaround estimates are not guarantees unless expressly stated in writing. Rush requests are subject to production availability and additional charges.

7. Changes, cancellations, and refunds

Changes or cancellations requested before production may be subject to charges for work performed, materials purchased, administrative costs, payment-processing fees, and other committed expenses. Once a proof has been approved or production has begun, the order may not be canceled or refunded.

Claims relating to a production error must be submitted in writing within three business days after receipt. Quixprint will evaluate the claim and determine an appropriate remedy. If a reprint is authorized, the customer may be required to return the entire original order.

8. Payment

Orders are prepaid unless written credit terms have been approved. The customer is responsible for applicable taxes, shipping, mailing, freight, duties, and other charges unless expressly included in the written quotation.

9. Shipping and delivery

Quixprint will make commercially reasonable efforts to meet estimated shipment and delivery dates but is not responsible for delays, loss, or damage caused by carriers, weather, labor disputes, equipment failures, supply disruptions, governmental action, natural disasters, or other circumstances beyond Quixprint’s reasonable control.

10. File storage

Customers should retain all source and production files. Quixprint is not obligated to retain files after a project is completed and may delete project files at any time after thirty days.

11. Website disclaimer

This website and its content are provided on an “as is” and “as available” basis. To the maximum extent permitted by law, Quixprint disclaims warranties regarding the website, its availability, and its content, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

12. Limitation of liability

To the maximum extent permitted by law, Quixprint will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost data, or loss of business. Quixprint’s aggregate liability relating to a project will not exceed the amount actually paid to Quixprint for the specific printed product giving rise to the claim.

13. Governing law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any dispute will be brought in a court of competent jurisdiction in Los Angeles County, California, unless otherwise agreed in writing.

14. Changes to these terms

Quixprint may update these Terms and Conditions at any time. Changes become effective when posted. Continued use of the website or continued ordering of services after changes are posted constitutes acceptance of the revised Terms.
